This document, designated as the Terms of Engagement ('the Accord'), establishes an understanding between you, the user of our hosting and associated offerings (collectively, 'the Offerings'), and Hosting tweb.host, in collaboration with LiquidNet US LLC, a United States entity based in Fort Lauderdale, Florida, and LiquidNet Ltd., a United Kingdom entity based in London, UK. All billing and hosting provisions are rendered by LiquidNet US LLC and LiquidNet Ltd. (with billing processes managed here). Legal information regarding these two entities can be located in the 'Customer Support Contact Information' segment of this document.

For conciseness, Hosting tweb.host, LiquidNet US LLC, and LiquidNet Ltd. will be referred to as 'We', 'Us', 'Our', and 'Service Provider' throughout this accord.


As a Client of our Offerings, it is important for you to recognize that by establishing an account with us, you confirm your acceptance and agreement to comply with our Web Hosting Terms of Engagement (this document) and our Guidelines for Acceptable Use (GAU). The completion of the Order Form for the Offering signifies the electronic endorsement of these two documents.

As a Client of our Offerings, you also acknowledge and accept that it is beyond our capacity to limit public access to the data you place on our servers or to guarantee the absolute security of your files. In this regard, you accept your obligation to safeguard all information you make accessible to the general internet public via our web hosting network and assume full responsibility for any disclosure of personal online data that could be misused.

COMPREHENSIVE ACCORD; SERVICE UNDERSTANDING

These Web Hosting Terms of Engagement, along with our Guidelines for Acceptable Use and the Domain Name Registration Understanding, form the complete agreement between You - the Client, and Us, the Service Provider. The Service Provider will deliver its Offerings to You under the Terms and Conditions detailed in this Service Understanding. This Accord aims to elucidate all facets, rules, and stipulations of the business relationship between You - the Client, and the Service Provider. It is also designed to preserve the integrity of this relationship and protect both parties from liability. This Service Understanding will be enforced, if and when necessary, to ensure the speed, power, performance, and reliability of our offerings.

Should a court of competent jurisdiction declare any of the Accord's provisions invalid, unenforceable, or void, the remaining provisions will fully retain their validity. The Client's side of the Accord may be represented by any of the following: an individual over 18 years of age; a legal entity, such as a corporation or a limited liability company. If an individual represents the Client for any reason, he or she must be legally authorized to act on the Client's behalf, thereby accepting, executing, and delivering the Accord.

This accord shall be interpreted in accordance with the laws of the State of Florida, US, and shall benefit the parties hereto and their respective heirs, executors, administrators, successors, and assigns.


HOSTING OFFERINGS

A web hosting offering is a type of Internet service that provides individuals and organizations/companies with the resources to host their websites and store information, images, video, and other content accessible via the World Wide Web. A Storage Service Provider (SSP) is a company that offers computer storage space and related management services. SSPs also provide periodic backup and archiving.

The Service Provider offers web hosting offerings, not solely data storage services. A web hosting offering includes the following:

OFFERING FEATURES

  • Disk Space: We utilize NVMe technology for highly available storage, significantly boosting both performance and reliability. This architecture ensures optimal efficiency, enhanced server stability, and smooth access to your allocated storage. The integration of NVMe technology elevates your hosting experience to meet the demands of modern applications and data-heavy workloads. For increased disk space, you may upgrade your plan. Payments are accepted annually in advance. For more information, please contact our sales team.

  • Traffic: Each hosting plan comes with a prepaid monthly traffic allowance in Megabytes. This quota is shared among all sites hosted within a single account. If a hosting account exceeds its permitted traffic quota, it will be suspended until the start of the next month when the quota automatically resets. Additional traffic can be purchased as an upgrade. Contact sales for details.

  • Hosted Domains: Our hosting plans include domain hosting. Each plan allows a specific number of domains to be hosted.

  • Domain Registration/Transfer: Available at standard or a reduced price (depending on the chosen Top-Level Domain - TLD) when purchasing a web hosting account. Each account can host a maximum of one domain name at a reduced price. Domain registrations are final and non-refundable. Further details regarding domain names are available later in these Terms of Engagement, in our Domain Name Registration Understanding, and in the Domain Name Dispute Resolution Policy.

  • Email Accounts: A varying number of email accounts can be set up with each web hosting plan.

  • MySQL/PostgreSQL Database(s): MySQL databases are included in all web hosting plans. Additional databases are available as an upgrade. PostgreSQL databases may be included or optional. Contact sales for clarification.

  • Database Storage: Each hosting account provides unlimited MySQL database storage. However, accounts with exceptionally large single databases can impact overall server performance. Therefore, it is recommended that each database be kept under 200 MB. For accounts with databases exceeding 500 MB, the Service Provider may request a reduction in total database usage to ensure proper performance or may terminate the account, with or without prior notice.

  • IP Address: Our hosting accounts do not include dedicated IP addresses unless specified in the plan features. Dedicated IP addresses can be purchased at any time as an upgrade to the web hosting offering. Dedicated IP addresses are acquired for a minimum of one year and are non-transferable to other web hosting providers. Contact sales for more information.

    • Important Note: According to IANA (the entity coordinating the global IP pool), newly requested dedicated IP addresses must be utilized within 7 days of allocation. If you request a dedicated IP from your Control Panel and do not assign it to a host within 7 days, the IP address will be returned to the global pool. You will then need to re-request it.

    • Important Note: Due to IANA restrictions for the Australian network space, dedicated IP addresses will not be available with a web hosting account ordered in the Australian data center.

  • SSH: If your hosting account does not include SSH access, please contact our sales department for information on obtaining it. Payment is accepted annually in advance only.

  • ID Protection: This service ensures your private contact information remains hidden in the domain's WHOIS details. It is optional for all hosting plans but available only with certain TLDs that support this feature.

INSTALLATION AND TROUBLESHOOTING

Each client can utilize our Installation & Troubleshooting service upgrade. This allows users to receive one-time expert assistance from our technical support team or system administrators for a 1-hour period. This service is intended for:

  • Hacked Site Cleaning and Restoration: If your website is hacked or reported as infected, we can assist in fixing it. This includes backing up current content, cleaning or restoring broken files from original script installations, or restoring from a previous copy.

  • Script, Theme, Plugin Installation: If you need software, theme/template, or plugin installation that you prefer not to handle, we can do it for you. We will back up the current site (if any) and complete the desired installation.

  • Script Troubleshooting and Debugging: If you encounter an issue with software that you cannot resolve, we can troubleshoot and fix it.

  • Manual File, Database, or Email Transfers: If you wish to move a site or a few sites to another account under our service, we can manage the migration for you seamlessly.

The Installation & Troubleshooting service will not apply in these cases:

  • Our installation service covers only new installations (no upgrades). We will not perform custom work or upgrade existing scripts to a newer version.

  • The service does not include any script configuration beyond the initial installation. After scripts are activated and operational, further tweaking and setup are the client's responsibility.

  • We only provide installation and troubleshooting if the hosting is provided by us on our Linux-Based Servers. The service is not available for any Windows, Linux, or MAC servers not powered and managed by us.

  • We offer no warranties and will not be held responsible for any data loss or any script, theme, or plugin not operating as intended.

"UNLIMITED" USAGE POLICIES AND DEFINITIONS

The term “UNLIMITED” describes resources in our web hosting plans that are not set to a predefined limit (e.g., unlimited bandwidth, unlimited disk space, unlimited emails). By not setting limits on key resources, we can offer clients a simple, consistent pricing model as their websites require more resources. Consequently, a typical website might experience periods of high popularity and increased storage needs without incurring additional hosting charges.

In all instances, when an offering is listed as “Unlimited,” it is intended for normal web hosting usage only. All activities that could result in excessive resource usage inconsistent with regular usage patterns are prohibited.

Our Unlimited offerings are not designed to allow a single user to negatively impact overall server performance. The Service Provider will endeavor to provide clients with additional resources when feasible, including relocating a client's hosting account to a newer, faster server. However, if resource usage reaches a level that could negatively affect overall server performance, the Service Provider reserves the right to take corrective measures. Such measures may include disconnecting or discontinuing any or all offered services, removing or deleting clients' websites, content, electronic mail, or terminating a client's account at the Service Provider's sole and absolute discretion.

SERVICE PAYMENTS AND RECURRING AGREEMENTS

Each client of the Service Provider can benefit from the package they purchased at the introductory price levels and with the same set of features throughout the entire agreement period. The Service Provider reserves the right to introduce certain changes to packages (such as complementary services) for the benefit of clients.

The Service Provider will charge clients fees based on the fee structure of the web hosting system at the time of the sign-up. The Service Provider reserves the right to introduce price changes to packages when necessary. This means the current price list on the Service Provider's online store may differ from the pricing of the Client's web hosting account.

When signing up for an account, the Client agrees to pay for a one-year period (365 days) and to adhere to the Order Verification Policy. The Sales Department will meticulously scrutinize each account order and carefully process each payment to ensure no fraudulent user can exploit the web hosting system.

When a Client pays for a web hosting plan with a domain via credit card or PayPal, a 12-month recurring billing subscription will be automatically created for convenience, for which the Client will receive a notification from the payment processor. All automatic payments are processed exactly 7 days before the due date to prevent any downtime if there is an issue with the credit card/PayPal account.

The Service Provider will send a payment reminder at least 24 hours before the automatic charge occurs.

The Client can cancel the subscription at any time from their Control Panel -> My Account -> Recurring, or directly through PayPal if it's a PayPal account subscription.

If standard payment methods are unsuitable for the Client's needs, alternative options such as Revolut or cryptocurrency payments may be available. Please contact the Sales team for further assistance.

SERVICE GUARANTEES

The Service Provider guarantees 99.9% network uptime and server stability. This guarantee, however, does not cover problems arising from:

  • Server Hardware Malfunction;

  • User error(s) or intentional interruption(s) of the user service (e.g., if the client shuts down their own server, the Service Provider is not responsible for the downtime);

  • Failure due to software not explicitly supported by the Service Provider. If a hardware crash caused by the client subsequently occurs, the Service Provider is beyond control and responsibility for the resulting downtime.

ACCOUNT/DATA BACKUP

Our backup service is provided as a courtesy. Therefore, the Service Provider will not be held responsible for files stored in your account. You, as a client, agree to take full responsibility for all files in your account and to maintain an appropriate backup of data stored on our servers. We will back up files located in the /www folder of your account, as well as databases you have created. Backups are retained for 7 days only. After this period, a backup cannot be restored.

  • General Backup: The default available backup disk storage space for each client is 10 GB. User accounts with content exceeding 10 GB cannot be (partially or entirely) backed up. Additional backup space is available via our Upgrade section in the Control Panel. We provide backup services only to accounts with disk space usage below the purchased backup quota. For example, if the purchased backup quota is 20 GB, we will back up your files as long as your account's disk usage does not exceed 20 GB. Once this 20 GB limit is reached, the backup script will no longer back up any of your files.

  • Database Backup: Our database backup script WILL NOT back up databases containing more than 256 tables. Larger databases take too much time and consume excessive server resources to back up.

SOCIAL MEDIA LOGIN

To simplify access to your account's Control Panel, you can set up Social Media Login, allowing you to log in with a chosen social media account instead of your username and password.

This is a voluntary process and requires you to provide your social media details, which will be stored in our system solely for associating your social media profile with your hosting account.

You can remove all social media details from our system at any time using the designated icon next to them. Otherwise, they will be retained until your account is terminated.

TIMELINES FOR SERVICE ACTIVATION AND CONTINUATION

30-DAY FREE TRIAL

All our web hosting plans include a 30-day free trial option, which can be enabled once a client has created an account. Only new clients are eligible for this offer. The free trial period expires 30 days after activation.

During the free trial, the account will operate with several limitations, which may vary based on the chosen package. More information will be sent to the Client at the start of the free trial. After the trial period ends, the Client will no longer have access to the Offering unless they complete their purchase.

All client data will be kept for up to 30 days after the free trial period ends. If the client does not complete the order process within that period, the data will be deleted from our servers.

At any time during the free trial, the Client may convert their free account into a standard paid account by clicking the “Complete Order” button in the Web Hosting Control Panel.

SERVICE ACTIVATION

  • For new clients: Services are activated immediately after our Sales Department contacts the client by phone to verify payment details (this is necessary due to high online fraud activity and to prevent fraudulent orders). The payment verification procedure is mandatory. If we fail to approve a transaction within 48 hours of payment submission, the funds will be credited back to the payer, and the order will be cancelled.

  • For existing clients: Services, including upgrades and renewals, are activated immediately after our Sales Department receives the corresponding service payment.

CONTINUANCE TIMEFRAMES

  • Shared Web Hosting Accounts: All newly created shared hosting accounts are valid for 1 year. They can be regularly renewed for another year, which is added to the account's official expiration date. All account upgrades purchased from the Web Hosting Control Panel are valid and functional until the final expiration date of the respective web hosting account.

  • Domain Name Registration/Transfer: The Service Provider offers registration/transfer for all TLDs (Top-Level Domains) displayed in the table below. TLDs can be purchased either with a shared hosting account (at regular or PROMOTIONAL price) or separately as an upgrade from the Web Hosting Control Panel (all TLDs at NON-PROMOTIONAL prices). The table below shows the minimum and maximum registration period, as well as the annual NON-PROMOTIONAL price of each TLD:

COMPLIMENTARY DOMAIN NAME OFFER

The Service Provider occasionally runs promotions offering complimentary domain names to clients signing up for a new web hosting account. This special offer is valid only with our PROMOTIONAL TLDs. However, if the money-back guarantee option is utilized, the domain name must be paid for ($9.95 per year per domain name). The domain name owner will have access to a domain management account and will be able to transfer the domain name to another registrar.


EXPIRATION AND RENEWAL OF OFFERINGS

HOSTING OFFERING
The hosting offering is active for one year (365 days). After this period expires, the account will be automatically suspended and will remain so until the Client renews it by paying the annual subscription fee. If the Client does not renew their hosting account, it will remain BLOCKED. Account data will be kept for two months, after which it will be permanently deleted.

Email notifications regarding account expiration are sent twice: 14 days and 7 days prior to the expiration date. To receive these notifications, the Client must provide a valid email address. The Service Provider ensures emails are sent but takes no responsibility for emails not delivered due to issues with the recipient's email address.

DOMAIN NAMES
Domain names are valid for the number of years of their registration (typically 1 to 10 years, depending on the TLD extension). After a domain name expires, several stages follow concerning its renewal.

The domain name Redemption Grace Period (RGP) is a registry-level period starting approximately 30 days after the domain's expiration date. During this period, the domain is held by the Registrar before deletion. The domain registrant can retrieve the domain, but this incurs an additional redemption fee. The RGP fee varies by TLD and registrar:

The RGP extends the time available for renewing domain names. However, any website or email services associated with the domain will cease functioning, and domains in redemption may be removed from zone files.

After the RGP (or renewal period, if RGP is not applicable) passes, domain names enter the Extended Redemption Grace Period (ERGP). During the first 120 days of the ERGP, you can redeem the domain by paying the redemption fee plus all registration fees. If you do not redeem the domain within this 120-day period, it will be considered abandoned, and you will have no further rights to its registration.

At that point, domain names may be: provided to third parties; auctioned by the Service Provider; or returned to the public registration pool. These actions can occur at any time without your consent.

Following the redemption period is the Pending Delete Period – a registry-level period of up to 5 days during which no one can renew the domain, and it cannot be newly registered as it has not yet returned to the public pool.

Released by Registry Period – the domain name is returned to the public pool and becomes available for new registration.

Clients are advised to renew their domain registrations before they enter redemption. Once a domain is in redemption, we can no longer prevent its zone files from being removed from the DNS system, and the client's website and associated services will stop working.

During a domain's redemption period, we can assist in retrieving it only if it was registered with us. The client must pay a REDEMPTION FEE (see table above). If registered elsewhere, the client must contact that registrar.


CLIENT OBLIGATIONS

ACCOUNT REGISTRATION AND MANAGEMENT

In using the Offering, clients agree to:

  • Provide true, accurate, current, and complete information about themselves as prompted by the registration form. Maintain and promptly update their registration data to keep it accurate. If a client provides untrue, inaccurate, non-current, or incomplete information, or if the Service Provider reasonably suspects such, we reserve the right to suspend or terminate the account and refuse any current or future use of the Offering. If false details are used to avoid VAT, the client may be held responsible by the relevant national tax authority.

  • Notify the Service Provider of any changes to their contact details within 10 business days after the changes take effect. This should be done online via the Web Hosting Control Panel, not by email. This requirement also applies to the Service Provider; clients will always be informed of any contact information changes on our website, ensuring clear communication.

  • Clients will receive a password and account designation upon completing registration. They are responsible for maintaining password and account confidentiality and are fully liable for all activities under their password or account. Clients agree to: a) immediately notify the Service Provider of any unauthorized password or account use or any other security breach; b) ensure they safely log out from their account at the end of each session. The Service Provider is not liable for any loss or damage arising from a Client's failure to comply.

  • If a hosting account is registered with details different from those of the person who paid, in case of a dispute, the Service Provider will side with the payer, who is considered the account owner (credit card/PayPal account holder).

  • If an account owner deceases before account expiration, the Service Provider requires a death certificate or other official legal evidence. Those supplying such information are legally responsible if it is false. The Service Provider will be the sole arbiter of document authenticity. A record will be kept until account expiration.

ACCOUNT USAGE

  • CPU Usage: Subject to regulations. Each hosting account can use up to 10% of CPU power for no longer than 180 seconds at any given time, and/or the percentage specified per 24 hours in the Client's plan features. Our web hosting plans include these CPU quotas (per 24 hours):

    We strongly recommend judicious CPU power use. We reserve the right to block files or scripts excessively using CPU and may suspend accounts impacting server performance or other accounts. If an account is blocked or suspended, the owner will be notified with an explanation and/or offered an upgrade.

  • Emails: Users are not permitted to:

    • Send more than 1500 emails per day / 150 emails per hour per hosting account (max 50 recipients per email, each unique recipient counts as one message sent).

    • Send more than 300 emails per day / 50 emails per hour per mailbox.

    • Consistently or abruptly exceeding these limits can lead to permanent reduction (to as low as 10 emails per day/hour) and/or SMTP disablement until resolved.

    • If you need to send more emails, open a support ticket for review.

    • Send more than 1500 emails a day using a mailing list (or 1 email to 1500 subscribers).

    • Repeat violations can result in IP restrictions or, in extreme cases, denial of email service.

    • Default email account storage is 10 GB. This can be modified in the Control Panel. All active email accounts under one hosting account must not exceed 40 GB total (60 GB for Ultimate plan). Each email account can host up to 200,000 stored messages.

    • Domain Manager plan email service has specific limits: max 250 outbound emails per day/25 per hour, 500 MB storage, 3 mailboxes.

    • Specific quotas are in the Account Usage table in the Control Panel.

    • Managing many mailboxes (over 3000) can cause high server load if frequent changes (password, alias) are made. We may then disable the account and request migration to a more resource-rich environment.

  • File Quota: No file count limit on any web hosting package.

  • Disk Space & Traffic: We offer generous amounts. Clients must not allow other websites/servers to link to files in their accounts (bandwidth theft). Accounts cannot be used as remote storage only or solely for sharing (un)archived files. At least 80% of files/total megabytes used (including MP3, WAV, RA, GIF, JPG, ZIP, RAR, etc.) must be part of active website content (linked by HTML/PHP files). Audio, graphics, video, backup/archive files (.zip, .tar.gz, etc.) must not exceed 50 GB or 25% of disk space, and no more than 50% of total monthly traffic. Upon request, clients must prove a file is part of an actual page within 24 hours. Failure to comply or continued misuse can lead to account suspension/content removal. Refunds are not applicable in such cases.

  • MySQL Usage: Each database can only be used by the user who created it. A user on another server/account cannot use it. MySQL databases have a limit of 45,000 queries per hour. If exceeded, access is blocked until the next hour when the counter resets. Max 15 simultaneous MySQL connections.

  • RAM Quota: Each account can use up to 2 GB RAM.

  • PHP Processes: Each account allowed up to 100 concurrent PHP processes.

  • Access and Error Logs: Total size for all client hosts in one account should not exceed 500 MB.

SERVER USAGE & HOSTED CONTENT

Server content MUST adhere to the parameters in these Terms of Engagement and our Guidelines for Acceptable Use (GAU). Web content requirements exclude illegal or otherwise inappropriate content. If any of our Offerings are used for illegal SPAM or UCE, they will be terminated instantly. We expressly forbid using any of our hardware or software hosted on our servers to illegally access another machine or network. For detailed information on prohibited uses, please review the next chapter and our GAU. Contact a Service Provider representative if you have further inquiries.

We offer complimentary themes with each hosting account. Images in featured sliders, logos, and background photos are for demonstration only, not part of the theme, and cannot be used on live client sites.
If your website is hacked/infected, we reserve the right to access your hosting account and delete corrupted files. This may not require account suspension, allowing your site(s) to return to normal.

Using our temporary URL is not defined as bandwidth stealing. However, clients should not rely on it as a primary URL. Traffic processing there is not recommended. We are not responsible for changing it later. Clients are advised to use it temporarily and redirect traffic to their own domains.


PROHIBITION OF UNLAWFUL OR FORBIDDEN USE

As a condition of using the Service Provider's Offerings, You - the Client, agree not to use them for any unlawful purpose or one prohibited by these terms, conditions, notices, and/or our Guidelines for Acceptable Use (GAU). Our servers are to be used explicitly and only for legal purposes. Any attempt to misuse the servers inconsistently with these rules will be immediately addressed.

You also agree not to use the Offerings in a manner that:

  • Is illegal, or promotes or encourages illegal activity such as Ponzi schemes;

  • Promotes, encourages, or engages in child pornography or the exploitation of children;

  • Promotes, encourages, or engages in terrorism, or violence against people, animals, or property;

  • Promotes, encourages, or engages in any spam or other unsolicited bulk email, or computer or network hacking or cracking;

  • Participates in or promotes the transmission of copyrighted material, material legally judged to be threatening or obscene, and material protected by trade secrets;

  • Violates the Ryan Haight Online Pharmacy Consumer Protection Act of 2008 or similar legislation, or promotes, encourages, or engages in the sale or distribution of prescription medication without a valid prescription;

  • Violates the Fight Online Sex Trafficking Act of 2017 or similar legislation, or promotes or facilitates prostitution and/or sex trafficking;

  • Infringes on the intellectual property rights of another User or any other person or entity;

  • Violates the privacy or publicity rights of another Client or any other person or entity, or breaches any duty of confidentiality You owe to another Client or any other person or entity;

  • Interferes with the operation of the Service Provider's Offerings;

  • Contains or installs any viruses, worms, bugs, Trojan horses, or other code, files, or programs designed to, or capable of, disrupting, damaging, or limiting the functionality of any software or hardware; or

  • Contains false or deceptive language, or unsubstantiated or comparative claims, regarding the Service Provider's Offerings.

Our servers CANNOT be used for propagating, distributing, housing, processing, storing, or handling lewd, obscene, adult, or pornographic material, or any other material deemed impermissible by these Terms of Engagement and our GAU. Clients may not attempt unauthorized access to any of our Offerings, other accounts, computer systems, or networks connected to our Offerings, through hacking, password mining, or other means. Clients may not obtain or attempt to obtain any materials or information through means not intentionally made available by our Offerings.

Clients are solely responsible for their message content. Using our Offerings for surveys, contests, pyramid schemes, chain letters, junk email, spamming, or any duplicative or unsolicited messages (commercial or otherwise) is prohibited.

Hosting tweb.host reserves the right to determine the seriousness of each report and decide, at its discretion, which conduct does not comply with the stated requirements for server use.

Hosting tweb.host may refuse service to unlawful parties by deactivating a client's account. If we decide to discontinue services to a Client per this agreement, the Client will be informed with a detailed explanation.

Hosting tweb.host reserves the right at all times to disclose any information as deemed necessary to satisfy applicable law, regulation, legal process, or governmental request, or to edit, refuse to post, or remove any information or materials, in whole or in part, which contradict our GAU.

A full description of steps taken to deal with prohibited/unwanted content can be found in the Guidelines for Acceptable Use (section 5. Enforcement Measures).


CLIENT E-COMMERCE WEBSITES

When purchasing server space for creating online stores or related e-commerce activities, clients agree to be fully responsible for the development, operation, and maintenance of their websites, online stores, and e-commerce activities. The Client is solely responsible for approving, processing, and filling customer orders and handling customer requests or complaints. The Client is also solely responsible for paying or satisfying all taxes related to their website and online store. The Client bears responsibility for ensuring the security and confidentiality of any customer data (including credit card numbers) they may receive. Each client is in charge of all products, services, content, and materials on their e-commerce website, including:

  • The accuracy and relevance of Client Content and materials in the Client store or on its products;

  • Ensuring that Client Content and materials do not violate or infringe upon any person's rights;

  • Ensuring that Client Content and materials are not defamatory or otherwise illegal.

Each Client guarantees to the Service Provider that they own the right to use the Client Content and material, including all text, graphics, sound, music, video, programming, scripts, and applets. Each Client warrants that the use, reproduction, propagation, and transmission of Client Content and any contained information and materials do not, and will not:

  • Infringe or abuse any copyright, patent, trademark, trade secret, or other proprietary right of a third party;

  • Violate any criminal law or constitute false advertising, unfair competition, defamation, privacy intrusion; violate a right of publicity or any other law or regulation.

Each Client empowers the Service Provider to reproduce, copy, use, and propagate all and any part of the Client Content for ensuring and operating the Offerings. The Service Provider is granted the right to determine, at its discretion, the extent to which these operations are necessary.


INTERACTIONS WITH THIRD PARTIES

Any dealings with third parties (including advertisers) conducted through the Service Provider's Offerings, including participation in promotions, payment for goods and services, and/or any other terms, conditions, warranties, or representations associated with such dealings or promotions, are solely between the Client and the advertiser or other third party. The Service Provider shall not be responsible or liable for any part of such dealings or promotions.


CANCELLATION, REIMBURSEMENTS & MONEY-BACK; PAYMENT REVERSALS

CANCELLATION & REIMBURSEMENTS
Our accounts are established on a prepaid basis. Clients may choose to cancel their accounts at any time; however, a full service refund will only be issued if the cancellation request is made within 30 days of account purchase, in accordance with our Money-Back Guarantee Policy.

To cancel an account, the Client must send an email or support ticket to our Sales Department and provide any authentication credentials requested. Other forms of cancellation requests will not be accepted. Any incentives (free bonuses, etc.) offered upon sign-up will also be cancelled.

Domain name registrations/transfers, service upgrades, and web hosting plan renewals are considered non-refundable services and cannot be cancelled or refunded after activation upon client request. The Client will have the option to transfer their domain to another host.

Late cancellations, and accounts cancelled by the Service Provider due to violations of these Terms of Engagement (where the client has chosen not to rectify the violation), do not qualify for the 30-day money-back guarantee.

All credit requests for VISA, MasterCard, American Express, and Discovery payments are processed within 48 hours of refund request submission (by email or ticket). Funds will be credited back to the Client's credit/debit card according to the card issuer's terms.

All credit requests for PayPal payments are processed within 48 hours of refund request submission. Funds will be credited back to the Client's PayPal account according to PayPal's terms.

MONEY-BACK GUARANTEE POLICY
The Service Provider offers a 30-day money-back guarantee. If you are not satisfied with our hosting services, you can submit a refund request via a trouble ticket from your web hosting control panel, or by email to This email address is being protected from spambots. You need JavaScript enabled to view it., and receive a full refund for your hosting plan within 30 days of account purchase. NOTE: Domain name registrations/transfers are non-refundable (see section 10).

SSL certificate issuance, as a third-party service, is not covered by our 30-day money-back guarantee for web hosting. An SSL certificate buyer is eligible for a refund within 7 days of purchase.

All recurring payments, and payments made via wire transfer, Revolut, cryptocurrency, or any other on-demand payment option, are non-refundable and not covered by the 30-day money-back guarantee.

NON-REFUNDABLE SERVICES
These include: all service upgrades, wallet refills, and plan renewal services purchased from the Web Hosting Control Panel; all 1-year or multi-year domain registration or transfer services purchased at sign-up or from the Control Panel.

All domain registrations and transfers are final, non-refundable, and subject to a fee calculated based on the actual NON-PROMOTIONAL annual price of the TLD, multiplied by the years of registration/transfer. Any refund credited per our 30-day money-back guarantee will not include the cost of non-refundable services (if any) purchased with the hosting plan (i.e., a partial refund if non-refundable services were bought). A table with annual NON-PROMOTIONAL domain prices is in section 3 of this document.

PAYMENT REVERSALS (CHARGEBACKS)
Chargebacks are not the method for processing refunds. If a client initiates a payment dispute for a purchase, a thorough investigation will occur.

By signing up for our services, the client acknowledges and accepts the terms in both the Guidelines for Acceptable Use (GAU) and these Web Hosting Terms of Engagement, which serve as proof of agreement. If a client files a chargeback claiming to dispute points they initially agreed to, we and our authorized retailers (PayPal and Stripe) will refer to these documents for resolution.

If a chargeback is initiated, the client’s account will be temporarily deactivated to prevent fraud. The account will remain suspended until the chargeback reasons are investigated and action is determined.

Common chargeback resolution scenarios:

  • If due to misunderstanding, the client must close the case with PayPal/issuing bank so we can initiate a reverse payment and reactivate the account.

  • If a client submits an unfounded chargeback (per our assessment and documentation), we will dispute it with our retailers.

    • The retailers will review all clauses to determine if grounds for chargeback were legitimate or if we are entitled to a reverse payment.

    • While the chargeback is underway, the client can have their account reactivated by covering initial service costs plus a non-refundable $30.00 USD fee (payable only via bank wire transfer).

Non-Refundable Dispute Fee and Its Purpose
To facilitate effective dispute resolution, we impose a non-refundable Dispute Fee on transactions initiated by PayPal customers or those using Credit/Debit card Checkout in two scenarios:
1. PayPal Dispute: When a customer directly initiates a dispute via PayPal.
2. Chargeback or Bank Reversal: When a customer files a chargeback with their card issuer or initiates a bank reversal.
This fee covers costs associated with managing dispute resolution, enabling prompt and fair investigation for all parties. It is essential for maintaining a secure and reliable platform.


PUBLIC ANNOUNCEMENTS

Certain sections of the Service Provider's public announcements may contain forward-looking statements projecting future events, such as new software integrations, updates, promotions, or hosting introductions. It is possible these statements may differ from actual circumstances, as they represent intentions and approximate plans regarding forthcoming events.

Forward-looking statements can often be identified by indicative words such as "believes," “anticipates," "plans," "may," "hopes," "can," "will," "expects," "is designed to," "with the intent," "potential," etc. However, the presence of these words is not a prerequisite for a statement to be considered forward-looking.


ABUSIVE CONDUCT

Any form of disrespectful treatment towards a Service Provider employee will be considered entirely inappropriate and unacceptable. Each Client is expected to communicate in a thoroughly polite and professional manner with our employees regarding any request for assistance, consultation, or any other reason for contact via email, chat, phone, or our Ticket Desk Support System. Each Client must avoid emotional outbursts, inappropriate language, or any attempt to undermine the importance of good ethics in communication and human relations. Any act of this nature, or other offensive, abusive, disrespectful, or condescending behavior—oral, written, or delivered by a second party—to members of our customer care staff will be interpreted as a breach of these Terms of Engagement. The Service Provider reserves the right to assess, at its sole discretion, which behavior constitutes a violation and to take appropriate actions, including refusing refunds to users whose accounts have been suspended for such violations.


UNFORESEEABLE CIRCUMSTANCES (FORCE MAJEURE)

The Service Provider CANNOT and WILL NOT be liable for any failure or delay in performing its professional duties resulting from circumstances beyond its direct physical control. Such circumstances may include acts of any governmental body, war, rebellion, sabotage, embargo, fire, flood, strike or other labor disturbances, interruption of or delay in transportation, unavailability of, interruption or delay in telecommunications or third-party services (including DNS propagation), failure of third-party software or hardware, or inability to obtain raw materials, supplies, or power used in or equipment needed for provisioning the Offerings.


PROVISION OF OFFERINGS; GUARANTEES AND ASSURANCES

You understand and agree that the Offering is provided on an ‘AS-IS' basis without warranties or representations for its delivery. The company bears no responsibility for connection problems if a client's hosting with us experiences service interruption issues. The Service Provider assumes no liability for any service failure, or failure to deliver or store any Client communication or personalization settings.


CESSATION OF OFFERINGS

The Service Provider reserves the right to discontinue delivering the offerings and terminate this accord for a certain period or indefinitely, with prior notice. If the reason for this is the Client's failure to observe these Web Hosting Terms of Engagement and/or our Guidelines for Acceptable Use, no refund will be issued for the unused period of their annual subscription. If the Client has not violated any part of these Web Hosting Terms of Engagement, the Guidelines for Acceptable Use, or any other related client agreements mentioned herein, the Client will receive a partial refund covering the unused period of their web hosting subscription.


COMPLAINTS RESOLUTION PROCESS

The Service Provider is dedicated to providing the highest levels of customer service around the clock. If you feel dissatisfied with any aspect of our service, you are encouraged to use our complaints procedure detailed below.

Provide as many details about your particular case as possible. The more information we have, the better, more prompt, and adequate our resolution will be.

Our steps for addressing every complaint are:

  1. We will confirm receipt of your complaint in writing, notifying you that it will be addressed without delay. We reserve the right to refuse to investigate complaints that are apparently frivolous, abusive, or offensive.

  2. Our Customer Care representative will review your situation, search for an appropriate solution, and inform you of the timeframe within which a response should be expected.

  3. If our Customer Care representative cannot resolve your case within the pre-announced period, your complaint will be escalated to a Customer Care manager.

  4. If the Customer Care manager also cannot provide an appropriate solution, your complaint will be forwarded to the Company Director, who will further investigate and ensure all necessary measures are taken. The Company Director will respond in writing within two working days and reply with a solution within five working days.

TRANSFERABILITY

Clients do not have the right to assign this Accord without the explicit permission of the Service Provider. This Accord shall be in force and effect to the total benefit of the Client and the Service Provider, and their successors and permitted assigns.


TERMINATION

You agree that the Service Provider, at its sole discretion, may terminate your password, account, or use of the Offering (or any part thereof), and remove and discard any Content within the Offering if you violate this Accord.
